Welcome to Medhva. These Terms of Service (“Terms”) govern your access to and use of the Medhva website, platform, mock tests, analytics, AI-powered study tools, and related services (collectively, the “Services”). By creating an account, accessing, or using Medhva, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use Medhva.
1. About Medhva
Medhva is an AI-powered learning mentor designed to help students preparing for competitive exams such as SSC, Police, Banking, Railways and Other exams identify weak topics, review mistakes, analyze performance, and access structured study roadmaps. Medhva is an independent educational technology platform and is not affiliated with, endorsed by, or sponsored by the SSC, UPSC, Police, IBPS, SBI, Railways, or any other government examination authority unless explicitly stated.
2. Acceptance of These Terms
By accessing or using the Services, you agree to comply with and be legally bound by these Terms, our Privacy Policy, and any other policies or guidelines we may make available on the Platform from time to time. These Terms constitute the entire agreement between you and Medhva with respect to your use of the Services.
3. Eligibility and User Accounts
To use certain features of Medhva, you may need to create an account. By creating an account, you agree that:
- You will provide accurate, current, and complete information.
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activities that occur under your account.
- You will notify us promptly if you believe your account has been accessed without authorization.
If you are under the age of 18, you may use Medhva only under the supervision of, and with consent from, a parent or legal guardian. By allowing a minor to use the Services, the parent or legal guardian agrees to these Terms on the minor’s behalf and is responsible for the minor’s use of the Services.
We reserve the right to suspend, restrict, or terminate accounts that violate these Terms or pose a risk to the Platform or other users.
4. Educational Purpose Only
Medhva is intended for educational and informational purposes only. While we aim to provide helpful mock tests, study analytics, and AI-powered recommendations, Medhva does not guarantee any specific exam result, score improvement, rank, selection, or outcome.
Your performance in any examination depends on multiple factors outside our control, including your preparation, consistency, exam conditions, and official exam standards.
5. AI Features and Recommendations
Some features of Medhva may use automated systems, analytics, or AI-generated recommendations to provide study guidance, performance analysis, topic-level insights, or learning suggestions.
You acknowledge and agree that:
- AI-generated outputs are provided for informational and educational assistance only.
- Such outputs may not always be complete, accurate, or error-free.
- AI-generated suggestions should not be treated as guaranteed, authoritative, or professional advice.
- You remain responsible for how you use any recommendations, insights, or study plans generated by Medhva.
6. Acceptable Use
You agree that you will not:
- Copy, scrape, resell, sublicense, redistribute, or commercially exploit any part of the Services or content without our prior written permission.
- Use the Platform to cheat, impersonate another person, or manipulate mock test results or platform analytics.
- Upload, post, or transmit any unlawful, abusive, harmful, defamatory, fraudulent, or infringing content.
- Attempt to interfere with, disrupt, reverse engineer, probe, or gain unauthorized access to the Platform, its servers, infrastructure, or related systems.
- Use bots, scripts, automation, or other means to extract data, abuse the Services, or circumvent access controls.
- Misuse the Platform in a way that harms Medhva, its users, or the integrity of the Services.
Violation of this section may result in immediate suspension or termination of your access.
7. Paid Features, Subscriptions, and Billing
Certain features of Medhva may be offered as paid plans, subscriptions, or premium services, either now or in the future.
If you purchase any paid feature:
- Pricing, billing terms, renewal details, and any applicable refund policy will be displayed to you before purchase.
- You agree to pay all applicable fees and charges associated with your purchase.
- Unless otherwise stated, subscriptions may renew automatically until cancelled by you.
- Any refunds, if offered, will be governed by the refund terms displayed at the time of purchase.
We reserve the right to change pricing, plans, or available paid features at any time, subject to applicable law and reasonable notice where required.
8. Intellectual Property
All content and materials available through Medhva, including but not limited to text, questions, mock tests, analytics, design, branding, graphics, software, interfaces, and compilations, are owned by or licensed to Medhva and are protected under applicable intellectual property and proprietary rights laws.
Except as expressly permitted by us in writing, you may not copy, reproduce, distribute, publish, modify, create derivative works from, or otherwise exploit any part of the Services or content.
9. Third-Party Links and Services
Medhva may contain links to third-party websites, services, or tools, including payment processors, messaging platforms, or social channels. We do not control and are not responsible for the content, availability, policies, or practices of third-party services. Your use of third-party services is at your own risk and subject to their terms and policies.
10. Platform Availability and Changes
We may Modify, Suspend, Discontinue, Improve, or Update any part of the Services at any time, including features, tests, analytics, roadmaps, AI tools, or content.
We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free. We may perform maintenance, updates, or changes without prior notice where reasonably necessary.
11. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, Medhva disclaims all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, or reliability.
Without limiting the above, we do not warrant that:
- the Services will meet your requirements or expectations;
- the Services will be uninterrupted, timely, secure, or error-free;
- any study recommendations, analytics, or AI-generated outputs will be accurate, complete, or suitable for your needs; or
- use of Medhva will lead to any particular exam result, score, or academic outcome.
12. Limitation of Liability
To the maximum extent permitted by law, Medhva, its founders, team members, affiliates, licensors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of, or inability to use, the Services.
This includes, without limitation, damages for loss of data, loss of study progress, loss of opportunity, exam performance outcomes, service interruptions, account access issues, or any reliance placed on content, analytics, or AI-generated outputs.
To the extent liability cannot be excluded under applicable law, Medhva’s aggregate liability shall be limited to the amount paid by you to Medhva, if any, for the Services in the 12 months preceding the claim.
13. Indemnification
You agree to indemnify, defend, and hold harmless Medhva, its founders, affiliates, employees, contractors, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
- your use or misuse of the Services;
- your violation of these Terms;
- your violation of any law or third-party right; or
- any content or material submitted, posted, or transmitted by you through the Services.
14. Suspension and Termination
You may stop using the Services at any time and may request deletion of your account by contacting us.
We may suspend, restrict, or terminate your access to the Services at our sole discretion if we reasonably believe that you:
- have violated these Terms;
- have engaged in fraud, abuse, scraping, impersonation, academic dishonesty, or manipulation of the Platform;
- have created security, legal, or operational risk for Medhva or other users; or
- have otherwise used the Services in a harmful or unauthorized manner.
Upon suspension or termination:
- your right to use the Services will immediately cease; and
- any provisions of these Terms that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, disclaimers, limitation of liability, indemnity, and dispute resolution.
We may retain certain information as required by law or for legitimate business purposes such as fraud prevention, dispute resolution, security, and record-keeping, as described in our Privacy Policy.
15. Privacy
Your use of Medhva is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your information. By using Medhva, you acknowledge that you have read and understood our Privacy Policy.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may notify users through the Platform, by email, or by other reasonable means. Your continued use of the Services after updated Terms become effective constitutes your acceptance of the revised Terms.
17. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Lucknow, Uttar Pradesh, India.
